In Georgia, an allegation involving four grams of fentanyl can trigger a trafficking felony even without evidence of a sale. The threshold carries a mandatory prison term of at least 10 years, while greater amounts bring longer terms and higher fines.
Georgia changed its weight rule on May 5, 2026. Current law focuses on the amount of fentanyl in a mixture, not simply the gross weight of a pill, powder, or other material containing it.
The Current Four-Gram Fentanyl Trafficking Threshold
Under O.C.G.A. § 16-13-31(b.1), a person commits fentanyl trafficking by selling, manufacturing, delivering, bringing into Georgia, or knowingly possessing four grams or more of fentanyl. The statute also covers specified fentanyl analogs, salts, and isomers.
The charge doesn’t require proof of an intended sale. Alleged possession alone is sufficient if the State proves the required knowledge, the identity of the substance, and the statutory weight.
Under the statutory language effective May 5, 2026, a mixture must contain at least the threshold amount of fentanyl. Its total gross weight doesn’t establish the fentanyl weight. That distinction makes laboratory testing and the method used to quantify fentanyl content important issues.
The Fentanyl Eradication & Removal Act created the fentanyl-specific framework that took effect July 1, 2025. Older articles and discussions of prior law may rely on outdated mixture-weight language.
Mandatory Minimums by Fentanyl Weight
Georgia law sets four weight tiers, each with a minimum prison term and fine:
- Four to less than eight grams: 10 years and $75,000.
- Eight to less than 14 grams: 15 years and $150,000.
- Fourteen to less than 28 grams: 25 years and $250,000.
- Twenty-eight grams or more: 35 years and $750,000.
O.C.G.A. § 16-13-31(h)(2) sets a maximum punishment of 40 years in prison and a $1 million fine for this offense. The statutory minimum is a sentencing floor, not a prediction of what will happen in a particular case. The charge, admissible evidence, criminal history, and any applicable statutory departure all matter.
What the State Must Prove
An accusation isn’t proof. The State must establish that the accused knowingly possessed, sold, manufactured, delivered, or brought into Georgia the substance at issue, that it was fentanyl or another covered compound, and that the fentanyl amount met the applicable threshold.
Georgia doesn’t require proof that a person knew the exact number of grams involved. The State must still prove knowing possession. Actual possession means the substance was on the person. Constructive possession means the person knew of the substance and had the power and intent to control it without physically holding it.
Constructive possession cases often turn on who had access to a car, home, room, bag, or container. Mere proximity to drugs doesn’t resolve every possession question. A defense review should also examine the search or stop, chain of custody, laboratory identification, and testing used to establish weight.
How Laboratory Testing Affects the Weight Threshold
Because the statute measures fentanyl itself, laboratory methodology is central to determining whether the evidence reaches a weight tier. Fillers, cutting agents, pill binders, and other controlled substances contribute to a sample’s gross weight but not its fentanyl content.
The evidence raises several questions:
- Whether the laboratory identified fentanyl rather than another substance.
- Whether testing quantified the fentanyl content in the seized mixture.
- Whether the reported amount corresponds to the threshold in effect on the alleged offense date.
- Whether law enforcement lawfully obtained and preserved the evidence.
The answers depend on the evidence from the individual arrest. Reviewing laboratory records, warrants, and body-camera footage provides more reliable information than treating the initial accusation as a final result.
When a Court May Go Below the Mandatory Minimum
Absent a statutory exception, no portion of a trafficking sentence may be suspended, stayed, probated, deferred, or otherwise withheld. O.C.G.A. § 16-13-31(i) prohibits those alternatives unless an exception under subsection (g) applies.
One exception involves substantial assistance that identifies, arrests, or convicts accomplices or co-conspirators. A district attorney may file a motion seeking a reduced or suspended sentence on that basis. The option isn’t automatic and requires careful legal consideration because it carries serious practical consequences.
The statute also authorizes a sentencing departure when its conditions are satisfied. Those conditions include that the defendant had no leadership role, possessed no firearm or dangerous weapon, caused no death or serious bodily injury, and had no prior felony conviction. The court must make the required findings, including that imposing the minimum would result in injustice.
The statute also permits a below-minimum sentence when the prosecution and defendant agree to one. These narrow paths are part of the sentencing analysis after a review of the charge and supporting evidence. They don’t replace a full defense evaluation.
Early Defense Planning After a Savannah-Area Arrest
Early review matters because a case can turn on a statutory threshold, laboratory result, or possession theory that requires prompt investigation. We examine:
- The charging statute.
- The alleged fentanyl measurement.
- The possession evidence.
- The circumstances of the search or arrest.
- The sentencing exposure created by the allegation.
For arrests in Chatham County, felony drug cases begin with initial proceedings in Recorder’s Court or Magistrate Court before proceeding to Chatham County Superior Court. These early stages affect bond, evidence preservation, and the direction of the case, so delays make an effective response more difficult.
Statutory penalties explain the stakes, but they don’t establish whether the State can prove every required element or overcome a legal challenge. For drug trafficking defense in state or federal criminal cases, call Schneider Lerch, LLC 24/7 at (912) 417-5008.
